Social Security Appeal Attorney in Georgia

Challenge an SSDI or SSI Denial with Clear Guidance

A denial doesn’t end your opportunity to pursue Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. Carmichael Law Group represents Georgia claimants throughout the appeals process, with close attention to filing deadlines, medical evidence, and the reasons stated in the denial notice.

We’ve focused on disability law for more than a decade and guided thousands of people through the disability claims process. We serve clients in Columbus, Georgia, Upatoi, and nationwide, helping them organize evidence and understand what comes next. Our services are available in English and Spanish.

Call (888) 687-6022 to discuss your denial with a Social Security appeal attorney serving Georgia and protect your opportunity to file the next appeal.

Deadlines for Georgia Social Security Appeals

The Social Security Administration generally requires an appeal within 60 days after you receive its decision. The agency usually presumes that you received the notice five days after the printed date unless you can show that it arrived later. The same 60-day deadline generally applies when requesting the next level of review.

Keep the denial notice and record when you received it. The notice identifies the decision being challenged and explains the applicable deadline. Contacting us promptly gives us time to review the decision, determine the appropriate filing, and prepare the appeal request.

Good Cause for a Late Appeal

A missed deadline doesn’t always prevent an appeal. We can pursue a late filing under the Social Security Administration’s good-cause standard, which allows the agency to consider why the request wasn’t submitted on time. Relevant circumstances can include a serious illness, a death or illness in the immediate family, or destroyed records.

This exception isn’t automatic. The agency considers the claimant’s explanation and circumstances, so a late request should clearly explain the delay and include relevant supporting information.

The Four Levels of a Social Security Appeal

We handle appeals from reconsideration through federal court review. The correct next step depends on the latest decision and the stage the claim has reached.

The four levels of review are:

  • Reconsideration: A new review of the claim by the Social Security Administration after the initial denial.
  • Administrative Law Judge Hearing: If reconsideration is denied, we request a hearing before an Administrative Law Judge. Georgia hearings may be assigned through the Social Security Administration’s Office of Hearings Operations system.
  • Appeals Council Review: The Appeals Council reviews qualifying challenges to an Administrative Law Judge’s decision. It considers additional evidence when the evidence is new, material, related to the period on or before the hearing decision, and reasonably likely to change the outcome.
  • Federal Court Review: After an unfavorable Appeals Council decision, a claimant may file a civil action in United States District Court, generally within 60 days of receiving the notice. A federal court can return a case to the Social Security Administration for a new hearing.

An approval can provide benefits dating back to the original disability application, subject to the program’s eligibility and payment rules. We track the claim’s procedural history and present evidence relevant to the current level of review.

Contingency Fees for Social Security Appeals

We represent clients on a contingency fee basis. Attorney fees come from past-due benefits recovered for the client, and clients don’t owe an attorney’s fee if we don’t recover benefits. Federal law also caps Social Security attorney fees.

This structure allows you to consult an attorney about a denied Social Security claim in Georgia without paying an attorney’s fee upfront. We also offer a free initial consultation to discuss the denial and the next available step.

Protect Your Right to Appeal a Disability Denial

Keep your denial notice when you contact us. We can review the decision, identify the appeal level, and determine whether the standard deadline or a late-filing request applies.
