Step 1: Confirm Your Appeal Deadline (And Don’t Guess)

In general, you have 60 days from the date you receive the denial notice to request an appeal. Social Security typically assumes you received the notice 5 days after the date on the letter, unless you can show otherwise. 

If you miss the deadline, Social Security may require you to show a “good reason” for being late, and an ALJ can dismiss a late appeal. 

Practical move: calendar the deadline the day you open the letter and start gathering what you’ll need immediately.

Step 2: File the Correct Type of Appeal for Your Stage

Your denial letter generally tells you which step applies next. 

Most disability cases follow a sequence like this:

  • Initial denial → Request for Reconsideration
  • Reconsideration denial → Request for Hearing before an Administrative Law Judge (ALJ) 

If you file the wrong request (or file it in the wrong place), you can lose time and create avoidable delays.

Step 3: Consider Carefully Before Starting a Brand-New Claim

Many people assume the best move is “re-applying.” Sometimes a new application may be discussed (for example, if an appeal deadline was missed), but in many situations, appealing is the cleaner way to preserve momentum and address what Social Security said was missing.
